This contract shall be interpreted in accordance with the Statutes of the State of Ohio and is to be performed in Summit County, Ohio, which shall serve as a venue for any suit between the undersigned parties.

If any provision of this contract shall be deemed invalid the same shall not alter the balance of this contract and the remaining provisions.

Members agree to keep and obey all rules and regulations now in force or in the future prescribed by Baynes Bodybuilding Gym for the use of the equipment and facilities , including locker rooms, changing rooms and posing room.

Baynes Bodybuilding Gym reserves the right to revoke this membership for cause if the Member fails to keep and obey such rules and regulations, or for reasons of nuisance, disturbance of other Members, moral turpitude, or fraud.

By the use of the facilities of Baynes Bodybuilding Gym and/or by the attendance of the facility owned by Baynes Bodybuilding Gym, the Member expressly agrees that Baynes Bodybuilding Gym shall not be liable for any damages arising from the personal injuries sustained by equipment therein.

By the execution of the agreement, Member assumes full responsibility for any such injuries or damage which may occur to the Member or his/her guests in, on, or about the premises of Baynes Bodybuilding Gym and does hereby fully and forever release and discharge Baynes Bodybuilding Gym and its owners, employees, and agents from any and all claims, damages, right of action, or cause of action, present or future, whether same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the Member’s or his/her guests use or intended use of Baynes Bodybuilding Gym or the facilities and equipment thereof.

I understand and agree that Baynes Bodybuilding gym is only supervised during standard business hours. If no employees are on sight and I choose to exercise, I acknowledge this is a possible danger and knowingly and voluntarily waive my rights to make a legal or equitable claim of any sort against Baynes Bodybuilding Gym and all of their owners, partners, employees, agents, etc.

In addition, Baynes Bodybuilding Gym, its owners, employees, and agents, shall not be responsible for any theft, loss, or damage to personal property brought in, on, or about the premises of Baynes Bodybuilding Gym.

Member warrants represent and agree that he/she is in good physical condition and that he/she has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise or that will be detrimental or inimical to his/her health, safety, comfort, or physical condition if he/she does engage or participate.

Member shall not be relieved of his/her obligations to make any payments herein agreed to, and no deduction or allowance from any said payments shall be made, by reason of the absence or withdrawal of Member from Baynes Bodybuilding Gym or by reason of Member’s failure to attend or use of Baynes Bodybuilding Gym.

By signing this document, I agree that if I am hurt or my property is damaged during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being releases on the basis of any claim for negligence. 

I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing.

I have read and understood this document and I agree to be bound by its terms.
